Fair Use Policy

Overview
This Fair Use Policy applies to all plans offered by Mitigation Audit LLC, with specific provisions for the Unlimited Plan ($15,000/month). Plans with defined file caps (Small Monthly, Medium Monthly, and Enterprise volume plans) are governed by hard monthly limits. The Unlimited Plan is subject to the soft fair use guidelines described below to ensure quality of service for all customers.
Plan Structure & File Limits
The following plans include defined monthly file caps that are strictly enforced:
- Small Monthly - $700/month: Up to 10 files per month.
- Medium Monthly - $1,800/month: Up to 30 files per month.
- Enterprise - $8,000/month: Up to 120 files per month.
- Enterprise - $12,500/month: Up to 250 files per month.
The following plan is subject to this Fair Use Policy in lieu of a hard file cap:
- Unlimited Plan - $15,000/month: High-volume processing without per-file charges, subject to the guidelines below.
What "Unlimited" Means
High-volume processing
Handle hundreds of files per month without per-file charges.
No throttling for normal business use
Use the Service for your legitimate claims operations.
Dedicated account manager
Work directly with us to scale appropriately.
Fair Use Guidelines
Reasonable Usage Threshold
The Unlimited Plan is designed for organizations processing up to 500 files per month. If your needs consistently exceed this threshold, please contact your account manager to discuss a custom enterprise arrangement.
Single Organization Use
All plans are for use by one organization only. Reselling, sharing, sublicensing, or white-labeling access to third parties is strictly prohibited under all plan types.
No Automated Bulk Abuse
Automated scripts or bots designed to flood the system are not permitted under any plan. Normal batch processing through approved channels is permitted.
Legitimate Business Use
The Service must be used solely for reviewing mitigation invoices in connection with your insurance claims operations. Use of the Service for any other purpose is prohibited.
Data Retention
Regardless of plan type, all uploaded documents are deleted from active processing servers within 30 days of report generation, in accordance with our Privacy Policy and Terms of Service. Encrypted backup copies are retained for no more than 30 days and are automatically purged via AWS Lifecycle Rules. This policy applies uniformly across all plans.
What Happens If You Exceed Fair Use
If usage on the Unlimited Plan significantly exceeds normal business patterns or affects service quality for other customers, we will:
- Contact you to understand your needs.
- Work collaboratively with you on a solution (e.g., a custom enterprise arrangement with dedicated infrastructure).
- Never suspend service without prior notice and a reasonable opportunity to resolve the situation.

For organizations with very high volume requirements (500+ files per month), we offer custom solutions including:
- Volume-based pricing
- Dedicated processing infrastructure
- Priority processing queues
- Custom API integrations
- On-premise deployment options (where feasible)
